If it is impossible to be completely sure of the innocence of a person recognised as a political prisoner, the doubts must be interpreted in his favour. It is necessary to abolish Article 282.2 of the Criminal Code of the Russian Federation (participation in the activities of a banned political organisation); all those who have been convicted under it are probably political prisoners. The remaining “extremist” articles must be reviewed as they are unclearly defined. Individuals convicted under Article 282 should be amnestied or pardoned if they did not commit violent acts. A working group on political prisoners in the Civil Council would work on a list of political prisoners suiting various political forces.

A short list of political prisoners is needed, indisputably recognised as such by society and the government. We should guide ourselves by Andrei Sakharov’s list, handed over to Soviet leader Mikhail Gorbachev at the beginning of perestroika, after which the release of political prisoners in the USSR began. Not all cases which appear to be political are actually fabricated, that is why they must be thoroughly investigated.
